1. Acceptance of Terms

By accessing or using the Arylie Studios website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and clients who access or use our website and services.

2. Services Description

Arylie Studios provides web design and development services, including:

  • Custom website design and development
  • Landing page creation
  • Website hosting and maintenance
  • Related consulting services

Specific service details, pricing, and deliverables are outlined in individual project proposals and agreements.

3. Free Sample Policy

We offer a free website sample to demonstrate our design quality before commitment. By requesting a free sample, you agree that:

  • The sample is provided as-is and may be subject to limitations
  • No commitment is required to receive a sample
  • We reserve the right to decline sample requests
  • The sample remains our intellectual property until a project is commenced

4. Payment Terms

Payment terms are as follows:

  • Base Website: Full payment required upon project commencement
  • Website + Hosting: Initial payment for development, monthly hosting billed in advance
  • First Month Free: Hosting promotions apply to the first month only

All payments are non-refundable once work has commenced on a project.

5. Intellectual Property

Upon full payment, intellectual property rights to the completed website transfer to the client, including:

  • Custom design elements created specifically for the project
  • Code and development work
  • Content created by Arylie Studios (excluding stock assets)

Arylie Studios retains the right to display completed work in our portfolio unless otherwise agreed in writing.

6. Revisions & Changes

Revision policies are as follows:

  • Reasonable revisions are included during the design phase
  • Major scope changes may incur additional charges
  • Once a project is approved and delivered, additional changes may be billed separately

We encourage clients to review deliverables carefully before approval.

7. Hosting Services

For clients subscribed to our Website + Hosting plan:

  • Hosting fees are billed monthly in advance
  • Hosting can be cancelled at any time with 30 days notice
  • Upon cancellation, website files will be delivered to the client
  • We are not responsible for third-party hosting or domain issues

We reserve the right to suspend hosting services for non-payment.

8. Client Responsibilities

Clients agree to provide:

  • Timely feedback and approvals
  • Content, images, and materials needed for the project
  • Accurate contact and billing information
  • Any required third-party access (domains, hosting accounts, etc.)

Delays in client feedback may affect project timelines.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Our services are provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for the specific service
  • We are not responsible for third-party services or integrations

10. Confidentiality

We treat all client information with strict confidentiality. Information shared during the project process will not be disclosed to third parties without explicit consent, except as required by law.

11. Termination

Either party may terminate a project:

  • With written notice for convenience
  • Immediately for breach of these terms

Upon termination, fees for work completed are non-refundable. Work in progress will be delivered upon request and payment of pro-rated fees.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.

13. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.
